Under Article 4 of the Convention on the Rights of the Child (CRC) and General Comment No. 19 (2016) on public budgeting, State Parties are explicitly obligated to allocate and effectively utilize public resources to protect, promote, fulfill and realize children’s rights. The emphasis is on the equity, efficiency, adequacy, effectiveness and sustainability of public resources that is prioritised to address the the needs of the most marginalized children particularly those impacted by inequalities and discrimination..
Nepal has established strong constitutional, legal and policy frameworks that guarantees children’s rights, however prioritisation and investment in children always remains a challenge. Based on the previous analytical reports, budget allocation and utilization continue to be unsatisfactory across all three tiers of the Government (federal, provincial, and local). The analysis is further limited with the absence of a comprehensive investment and expenditure tracking systems and mechanisms to monitor public expenditures dedicated to children’s rights; health, education, protection, participation, social protection and institutional development.
Since 2013, Children as Zones of Peace (CZOP) and Save the Children have been actively tracking and analyzing child-focused public investments with the available public budget information from relevant Ministries at federal and provincial, as well as the municipal level. This year, CWIN-Nepal, CZOP and Save the Children have collaborated to expand a comprehensive analysis of investment in children with an aim to strengthen evidence-based budget advocacy and child-responsive planning and budgeting.
This Terms of Reference (ToR) defines the scope of work for an Expert Consultant(s) / Consulting Firm to provide the essential technical and analytical support required for this initiative.
Article 4 of the Convention on the Rights of the Child (CRC) states:
“States Parties shall undertake all appropriate legislative, administrative and other measures for the implementation of the rights recognized in the present Convention.”
The Constitution of Nepal (2015) guarantees child rights as fundamental rights. Likewise, the Children’s Act 2018, Free and Compulsory Education Act 2018, and Local Government Operation Act 2017, National Child Rights Policy 2023, National Plan of Action for Children 2026-2030 that ensures provisions for essential services and mechanisms for children.
Adequate investment in children is essential for the effective implementation of these legal and policy commitments. Tracking and analyzing child-focused public expenditure is therefore necessary to assess government commitment, identify financing gaps, and advocate for child-responsive planning and budgeting.
The purpose of this consultancy is to conduct a child-focused budget analysis of relevant federal ministries to assess investment, allocations, and expenditures, related to children’s rights, including health, nutrition, education, protection, social protection, participation and institutional development for fulfilling children’s rights.
The analysis will examine whether adequate financial resources are allocated and effectively utilized in these sectors and further identify budget gaps, equity concerns, and expenditure trends to support evidence-based advocacy and policy engagement for child-responsive budgeting practices.
The consultancy aims to:
Analyze expenditure trends of the previous fiscal years (2080/81, 2081/82, 2082/83) and planned investments for children in Fiscal Year 2083/84 under federal ministries using the prescribed analytical tool. Assess child-focused budget allocation and expenditure across the four pillars of child rights: survival, development, protection, and participation, including institutional arrangements and capacity enhancement provisions.

The assignment is expected to require approximately 20 working days within the contract period.
During the consultancy period, the consultant shall closely coordinate with designated representatives for review, guidance, and finalization of outputs.
The consultant/organization shall maintain strict confidentiality regarding all information, documents, financial data, and processes accessed during the consultancy period. Such information shall not be disclosed, reproduced, shared or used for any purposes other than the assignment without prior written consent from CWIN-Nepal both during and after the completion of the assignment
The consultant/organization must strictly comply with the Child Protection Policy and safeguarding standards of CWIN-Nepal throughout the consultancy period.
