Consultancy Service for Analysis of Public Investment in Children

1. Background

Under Article 4 of the Convention on the Rights of the Child (CRC) and General Comment No. 19 (2016) on public budgeting, State Parties are explicitly obligated to allocate and effectively utilize public resources to protect, promote, fulfill and realize children’s rights. The  emphasis is on the equity, efficiency, adequacy, effectiveness and sustainability of public resources that is prioritised to address the  the needs of the most  marginalized children particularly those impacted by inequalities and discrimination..

Nepal has established strong constitutional, legal and policy frameworks that guarantees children’s rights, however  prioritisation and investment in children always remains a challenge.  Based on the previous analytical reports, budget allocation and utilization  continue to be unsatisfactory across all three tiers of the Government (federal, provincial, and local). The analysis is further limited with the  absence of a comprehensive investment and expenditure tracking systems and  mechanisms to monitor public expenditures dedicated to children’s rights; health, education, protection, participation, social protection and institutional development.

Since 2013, Children as Zones of Peace (CZOP) and Save the Children have been actively tracking and analyzing child-focused public investments with the available public budget information from relevant Ministries at federal and provincial, as well as the municipal level. This year,  CWIN-Nepal, CZOP and Save the Children have collaborated to expand a comprehensive analysis of investment in children with an aim  to strengthen evidence-based budget advocacy and child-responsive planning and budgeting.

This Terms of Reference (ToR) defines the scope of work for an Expert Consultant(s) / Consulting Firm to provide the essential technical and analytical support required for this initiative.

  1. Rationale

Article 4 of the Convention on the Rights of the Child (CRC) states:

“States Parties shall undertake all appropriate legislative, administrative and other measures for the implementation of the rights recognized in the present Convention.”

The Constitution of Nepal (2015) guarantees child rights as fundamental rights. Likewise, the Children’s Act 2018, Free and Compulsory Education Act 2018, and Local Government Operation Act 2017, National Child Rights Policy 2023, National Plan of Action for Children 2026-2030 that ensures provisions for essential services and  mechanisms for children.

Adequate investment in children is essential for the effective implementation of these legal and policy commitments. Tracking and analyzing child-focused public expenditure is therefore necessary to assess government commitment, identify financing gaps, and advocate for child-responsive planning and budgeting.

3. Purpose of the Consultancy

The purpose of this consultancy is to conduct a child-focused budget analysis of relevant federal ministries to assess investment, allocations, and expenditures,  related to children’s rights, including health, nutrition, education,  protection, social protection, participation and institutional development for fulfilling children’s rights.

The analysis will examine whether adequate financial resources are allocated and effectively utilized in these sectors and further identify budget gaps, equity concerns, and expenditure trends to support evidence-based advocacy and policy engagement for child-responsive budgeting practices.

4. Objectives

The consultancy aims to:

Analyze expenditure trends of the previous fiscal years (2080/81, 2081/82, 2082/83) and planned investments for children in Fiscal Year 2083/84 under federal ministries using the prescribed analytical tool. Assess child-focused budget allocation and expenditure across the four pillars of child rights: survival, development, protection, and participation, including institutional arrangements and capacity enhancement provisions.

  • Compare overall ministry budgets with investments allocated for children and prepare an evidence-based advocacy document to support child-responsive planning and budgeting.
  • Identify gaps, priorities, and opportunities for strengthening investment in children.

    b) Ministry of Women, Children, Gender and Sexual Minorities and Social Security (MoWCGSMSS)
    c) Ministry of Education, and Sports (MoESTI)
    d) Ministry of Health and Food Safety (MoHFS)
    e) Ministry of Youth, Labour and Employment (MoYLE)
    f) Ministry of Home Affairs (MoHA)
  2. Scope of Work

The consultant/consulting firm shall:

  • Review relevant policies, laws, budget documents, and literature related to child-focused public financing.
  • Collect and review Red Books and budget documents of the selected ministries.
  • Develop and finalize data entry and analysis formats in consultation with CWIN-Nepal.
  • Compile and analyze ministry-wise child-focused budget allocations and expenditures.
  • Categorize investments under the four pillars of child rights and as per the components and indicators listed in Child-responsive budget code procedures.
  • Analyze trends, gaps, equity dimensions, and institutional arrangements related to child-focused investments.
  • Prepare a draft analytical report and advocacy document.
  • Facilitate presentation/sharing sessions with relevant stakeholders.
  • Finalize the report incorporating feedback received.

6. Expected Outputs and Deliverables

The consultancy is expected to produce the following outputs:

  • Completed data compilation and analysis of child-focused investment from the selected federal ministries.
  • A concise analytical report with interpretation of findings and trend analysis.
  • An advocacy-brief / summary document highlighting key findings, gaps, and recommendations.
  • Presentation materials for dissemination and stakeholder engagement.

7. Methodology

The consultancy will be carried out mix method approach through the following processes:

  1. Inception meeting, agreement signing, desk review, and finalization of methodology and work plan.
    b) Collection and review of Red Books and relevant budget documents from selected ministries.
    c) Development and submission of data entry and analysis formats for approval.
    d) Data entry, verification, and compilation of investment information by ministry.
  2. Conduct KII and FGD with representatives of respective ministry, children, CSO stakeholders
    e) Analysis of investment trends using the prescribed tool and thematic framework.
    f) Categorization and analysis of investments under survival, development, protection, participation, institutional arrangements, and capacity enhancement.
    g) Submission and presentation of draft findings for review and feedback.
    h) Finalization and submission of the report incorporating feedback.

10. Eligibility Criteria

Interested consultants/firms should meet the following requirements:

  • Demonstrated experience in public finance system and analysis,  social sector budgeting, human rights / child rights, or governance-related research and/or advocacy.
  • Strong understanding of human rights / child rights frameworks, public budgeting systems, and government planning processes in Nepal.
  • Proven experience in conducting budget analysis and policy research.
  • Excellent analytical writing and presentation skills.
  • Experience working with Government, NGOs, INGOs, or development partners will be an asset.

11. Submission of Expression of Interest (EOI)

Interested consultants/organizations are requested to submit:

  • Technical Proposal
  • Separate Financial Proposal
  • Updated CV(s) of the consultant(s) or organizational profile
  • Copy of PAN/VAT Registration and Tax Clearance/Latest Renewal Certificates

12. Payment Modality

  • 50% of the total payment will be released upon submission and approval of the draft report.
  • Remaining 50% will be released upon submission and approval of the final report and all agreed deliverables.

Applicable taxes shall be deducted at source as per prevailing Government of Nepal laws.

13. Reporting and Supervision

The consultant/organization will work under the direct supervision of CWIN-Nepal and maintain regular communication throughout the consultancy period.

14. Duration of Consultancy

The consultancy period will be from:

15 June 2026 to 30 August 2026

The assignment is expected to require approximately 20 working days within the contract period.

15. Communication and Coordination

During the consultancy period, the consultant shall closely coordinate with designated representatives for review, guidance, and finalization of outputs.

  1. Confidentiality

The consultant/organization shall maintain strict confidentiality regarding all information, documents, financial data, and processes accessed during the consultancy period. Such information shall not be disclosed, reproduced, shared or used for any purposes other than the assignment without prior written consent from CWIN-Nepal both during and after the completion of the assignment

17. Child Protection Commitment

The consultant/organization must strictly comply with the Child Protection Policy and safeguarding standards of CWIN-Nepal throughout the consultancy period.
